Terms and conditions for the provision of electronic services by Przedsiębiorstwo Turystyczno-Handlowe Supertour Sp. z o.o. based in Warsaw.

 

1. Definitions

 

Booking system - a computer program allowing the user of a computer connected to the Internet to search for tourist events using any selected search parameters, valuing these events and making a purchase.
User - anyone using the booking system in any way; alternatively, the User may also be referred to as the Customer or the Client.

Tour Operator- a company/travel agency which creates a new service, i.e. a tour for an anonymous customer, on the basis of its own services and third party services. It offers this service on its own behalf, at its own risk and on its own account. It creates and promotes its own tourist product in the form of a ready-made package of services. For the purposes of these Terms and Conditions, airlines and other carriers are also considered as Tour Operators. Tour Operators are interchangeably called Organisers.

Service - an online service enabling Users to select, book, accelerate and simplify the procedure for entering into a tour and ticket purchase agreement among the offers presented by the Tour Operator. The service only allows for submitting a pre-reservation for the offer selected by the User.

Tourist Event - is at least two tourist services covered by a common programme and price, lasting more than a day. Companies providing services as part of a Tourist Event are subject to entry into the register of tour operators.

 

2. General Provisions


2.1. Pursuant to Article 8 Section 1.1 of the Act of 18 July 2002 on electronic services (Journal of Laws No. 144, Item 1204 as amended), Przedsiębiorstwo Turystyczno-Handlowe Supertour Sp. z o.o. based in Warsaw (hereinafter referred to as "PTH Supertour Sp. z o.o." or "Supertour") hereby establishes these terms and conditions governing the provision of services by electronic means, hereinafter referred to as "the Terms and Conditions".
2.2. The Terms and Conditions define the types, scope and conditions of providing services by electronic means by PTH Supertour Sp. z o.o. based in Warsaw, through www.supertour.pl (hereinafter referred to as "the Website"), conditions for obtaining information about the tourist offer, booking and purchase of a tourist event, as well as terms and conditions of conclusion and dissolution of agreements for the provision of services by electronic means and the complaint procedure.
2.3. The Terms and Conditions are an agreement between PTH Supertour Sp. z o.o. and the Users, defining the rules constituting the legal basis for using the Booking System, obligating the Users to comply with them. At the moment of taking action to use the Booking System, each User is obligated to abide by these terms and conditions.
2.4. The owner of the Website and the entity providing services through the Website is Przedsiębiorstwo Turystyczno-Handlowe Supertour Sp. z o.o. based in Warsaw, at ul. Niemcewicza 26, 02-306 Warsaw, entered in the register of companies maintained by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under number 0000046068, Tax No.: 526-030-17-64, Statistical No.: 006471321. PTH Supertour Sp. z o.o. is an agent of the Lufthansa City Center Group, creating an international network of travel agents on a franchising basis.


3. Types and scope of electronic services.


3.1. As part of providing services through the Website, the User may choose tours, stays in hotels and plane tickets offered by various Tour Operators cooperating with Supertour, and then make an initial booking and purchase a Tourist Event, hotel stay or a plane ticket
3.2. Materials, information or prices presented on the Website are not an offer within the meaning of the Civil Code.


4. Limitations of Liability


4.1. The data presented on the Website are data obtained from the Tour Operators. Supertour is not liable for their reliability or completeness. The actual availability of a given Tourist Event or ticket must be confirmed by the given Tour Operator, respective airline or carrier. Supertour shall not be liable to the User of the Website for failure to perform or improper performance of services covered by the booked Tourist Event, transport service, or other service available at www.supertour.pl, as it is the liability of the entity who directly entered into the agreement with the User.
4.2. Completion of required formal and legal conditions such as passport and visa requirements in the countries that require it is an obligation of the User making the booking and subsequently purchasing services through the Website. At the request of the User, Supertour provides information on visa conditions and assistance with visa formalities, but is not responsible for the results, in particular Supertour does not have an impact on the granting or refusal to grant a visa.


5. Making a Booking


5.1. The User making the initial booking of a Tourist Event declares having full legal capacity. By accepting the following terms, the User assumes full financial responsibility for the use of the Booking system. The User warrant that they will use the System to make inquiries about the booking and to purchase a ticket only in a manner consistent with applicable law, avoiding any actions aimed at obtaining unlawful claims. The User is forbidden to make an inquiry for a booking using a fake or someone else's name, and to pay for booked airline tickets and other services with a fake or someone else's credit card.
5.2. The User acknowledges that the data of the person for whom the initial booking is made should be consistent with the passport or ID card information when travelling within the European Union. In the event of non-fulfilment of the service purchased through the Website due to incompatibility of personal data included in the pre-booked reservation with data contained in a passport or ID card or other causes for which Supertour is not liable, the User's payment of all or part of the price shall be reimbursed by the applicable Tour Operator in accordance with the contract concluded with the Tour Operator.
5.3. Making a booking and purchase of a Tourist Event is unambiguous with reading and acceptance of the General Terms and Conditions of Participation of the Organiser of the Tourist Event and the provisions of these Terms and Conditions.


6. Payment


6.1. Depending on the length of the time between the booking and the date of commencement of the Tourist Event, two types of payments are possible:
- Partial payment in instalments - advance payment in percentage according to the General Terms and Conditions of Tour Operator Agreements (usually up to 40 days before the start of the tour)
- One-time payment (less than 40 days before the start of the event)


7. Service and Pricing Changes by the Organiser


7.1. Supertour declares that, as a rule, each Organiser reserves the right to make changes to individual services in relation to the agreed contents of the agreement, in accordance with the Organizer's General Terms and Conditions of Participation and Payment. Supertour is not liable for changes made by the Organiser under the agreement. If the User does not use individual travel services due to early return or other reasons, for which the Tour Operator is not responsible, then the service provider or Organiser is not obligated to reimburse the travel price. The User may enter into an appropriate insurance contract to cancel participation in the tour in full or in part.


8. Cancellation of Contract, Booking Change, Change of Participants


8.1. Changes made to the booking and cancellation after booking are subject to the terms and conditions set by the event Organiser.
8.2. Booking changes or cancellations can be made by sending a written request (stating the first and last name of the User and the booking number) to the e-mail address turystyka@supertour.pl.


9. Complaints


9.1. In case of dissatisfaction with the proper performance of the contract by the Organiser, the User has the right to lodge a complaint regarding the failure to perform or improper performance of the contract by the Organiser of services included in the Contract for the Tourist Event purchased through the Website.
9.2. Complaints should be submitted in writing to be valid, to the address of the Organiser of the Tourist Event. Complaints shall be recognised by the Organiser in accordance with the rules set out in the General Terms and Conditions of the given tourist event.
9.3. Complaints related to the quality of Supertour services should be addressed to Przedsiębiorstwo Turystyczno-Handlowe Supertour Sp. z o.o., ul. Niemcewicza 26, 02-306 Warsaw in writing or in electronic form and send to the email address: turystyka@supertour.pl. Supertour will process your complaint within 14 days from the date of receipt.


10. Protection of Personal Data


10.1. Data entered by the User into the Website will be processed by Supertour in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws, No. 133 Item 883) and in accordance with the provisions of the General Terms and Conditions for Touristic Events organised by Tour Operators.
10.2 The Website User agrees to the processing of their personal data by Supertour for the purposes of providing services through the Website. Provision of personal data is voluntary, but necessary for proper service delivery. At the time the data is processed, the person has the right to access their personal data and to correct them.


11. After-Sales Service


11.1. At any time, the User can contact a Supertour consultant and obtain information about the status of their booking, as well as additional information about the booked Tourist Event, as well as obtain answers to other questions about the booked Tourist Event.
11.2. At least 24 hours before the departure date, the User should contact the Organiser or directly the Supertour consultant to confirm departure time.


12. Using the Website


12.1 By using the Website, the User agrees to abide by generally applicable laws.


13. Final Provisions


13.1. The provisions of the Civil Code shall apply for matters not regulated by the provisions of these Terms and Conditions.
13.2. All disputes related to the services provided by Supertour are resolved by common courts of proper type and venue, in accordance with the Civil Code Act of April 23, 1964 (Journal of Laws of 1964, No. 16, Item 93, as amended)
13.3. By using the Website, the User accepts all provisions of these Terms and Conditions without any reservation.
13.4. Posting of the Terms and Condition on the website as well as posting every change of the terms and conditions is unequivocal with notifying the Users.
